The Coast Guard proposes to delay the effective date for the following two categories of facilities by three years, until August 23, 2021: • Facilities that handle certain dangerous cargoes in bulk, but do not transfer these cargoes to or from a vessel, and • Facilities that receive vessels carrying certain dangerous cargoes in bulk, but do not, during that ves- sel-to-facility interface, transfer these bulk cargoes to or from those vessels. Other vessels and facilities, including facilities that receive large passenger vessels and facilities regulated under 33 CFR 105.295 that handle certain dangerous cargoes in bulk and transfer it to or from a vessel, would still be required to comply with the final rule by August 23, 2018. The Coast Guard is accepting comments and related materials regarding this NPRM until July 23, 2018. PVAintends to submit comments on this proposal.   For years, PVA has highlighted the fact that current security measures aboard U.S. flagged passenger vessels make TWIC and TWIC Readers un- necessary for domestic passenger vessels and the facilities at which they call. Accordingly, when the initial TWIC Reader final rule was issued, PVA was pleased that the Coast Guard exempted nearly all PVA vessels, and most PVA facilities.  However, PVA is disappointed that the Coast Guard is not proposing to delay the upcoming August 23 effective date to install and use TWIC Readers at “facilities that receive vessels carrying more than 1,000 pas- Coast Guard Proposes to Delay Implementation of TWIC Rule, but not for Facilities Receiving Large Passenger Vessels sengers.” The risk analysis model used by the Coast Guard in making this decision is unfortunately not available to the public and, as a result, PVA has no meaningful ability to comment on the risk assigned to this group. Under current Coast Guard rules, operators of facilities receiving larger passenger vessels may apply for a TWIC Reader waiver, and PVA is assisting the small number of facilities impacted in doing so. n
