Fines Issued to Rail Jumper Offenders In a separate enforcement action, Coast Guard Sector Northern New England has issued a notice of violation in the amount of $2,500 to an individual who jumped off a Casco Bay Lines ferry while it was returning to the State Pier in Portland, ME. This is not an isolated incident. Nationwide, the Coast Guard has increased actions taken against persons in violation of “Interfering with the Safe Navigation of a Vessel.” This law is more commonly referred to as the “Rail Jumper or Wake Jumper Safety Amendment” because of its most common application. The law allows Coast Guard to issue a civil penalty to any offender who is acting in such a way that interferes with the vessel’s safe navigation. In August, in Portland, OR, the Coast Guard issued a $5,000 fine to a passenger who jumped overboard into the Willamette River from a tour boat. Local Coast Guard personnel commented, “Jumping into the water from a certificated passenger vessel, such as a tour boat or charter vessel, is not only dangerous for the person jumping but it also endangers the lives of others onboard,” Capt. Thomas Griffitts, commanding officer, Marine Safety Unit Portland. “Commercial passenger vessel crews are responsible for the safety of all passengers aboard their vessels, and in this case, their attention was diverted away from the safe operation of the vessel when they were forced to retrieve the jumper from the water.” PVA’s advocacy efforts were instru- mental in successfully urging Congress to give the Coast Guard the authority to impose a civil penalty for interfering with the safe operation of a commercial vessel.
