NPRM Docket No. USCG-2016-0748 proposed raising the current threshold of $25,000 set in 1980 to $72,000 and the higher level serious marine incident (SMI) set on 1987 from $100,000 to $200,000. Tie basis of this raise was the reported cost of living change in the Consumer Price Index for All Urban Consumers (CPI-U). The referenced regulations addressed in the NPRM are 46 CFR 4.03-1, 4.03-2 and 4.05-1. The Coast Guard in 46 CFR 4.03-1, defines incidents as marine casualties that, due to their nature could or do, reflect the efficacy of existing marine safety regulation, point to the need for new regulation or those instances that could produce evidence that may lead to further administrative penalties, sus- pension and revocation of mariner cre- dentials or referral for criminal action. The Coast Guard in 46 CFR 4.03-2 defines the level at which reportable incidents because of their severity as economic costs are defined as serious marine incidents (SMI). These require immediate alcohol and drug tests for persons directly involved in a SMI casualty. For property damage SMI defines a reporting threshold of four times the threshold dollar value for 46 CRFR 4.03-1 and 46 CFR 4.05-1 casualty or accident reports.
