O n August 19, 2016, the Federal Communications Commission (FCC) issued an order granting a blanket waiver that allows domestic passenger carrying vessels operating on Coastwise and Limited Coastwise routes to use a Class D VHF Radio equipped with Digital Selective Calling (DSC) in lieu of a Class A DSC VHF radio. This order is the culmination of months of work by PVA, affiliated groups, and the U.S. Coast Guard, to reduce the burden of an inappropriate regulation implemented by the FCC. FCC Requirements Coast Guard requirements for radio installations and marine operator re- quirements defer to FCC regulations in Title 47 Code of Federal Regulations (CFR) Part 80. When the requirements of Title 47 CFR 80.905(a)(1) became effective on January 20, 2016 inspected passenger vessels operating in SeaArea A1 were required to upgrade to DSC VHF radios. Sea Area A1 was declared on January 25, 2015 by the Coast Guard, defined to be within 20 nautical miles seaward of the territorial baseline along the East, West, and Gulf coasts of the United States, excluding Alaska, but including Hawaii, Puerto Rico, Guam, and the U.S. Virgin Islands. Since 2015, the Coast Guard attained Rescue 21 distress system coverage in that offshore area and FCC requirements had a one-year implementation period. Class A DSC VHF radios are the default requirement under the regula- tions, but those units are designed for large ocean-going ships subject to in- ternational SOLAS requirements. There is a waiver provision in the regulations to allow Class D units, but the vessel owner must submit a waiver request and pay a $195 filing fee.
