The entire course focuses on violation analysis so that the student learns about the full spectrum of remedial options from Letter of Warning to S&R courtroom processes. An additional means of assistance to the process is that the S&R National Center of Expertise will provide the investigator with expert legal advice and support for every S&R hearing. The Center also provides resources to support the continuing education of in- vestigating officers. Similarly, the Coast Guard is providing renewed guidance through a new Civil Penalty Enforcement, Tactics, Techniques, and Procedures (TTP) document to aid the investiga- tor initiating, validating and forward- ing a proper Civil Penalty case to the Hearing Officer. Lastly, the recommendation was made for Hearing Officers to communi- cate the final decision on Civil Penalties to the field forces. This is accomplished by placing a final copy of the decision in Marine Information for Safety and Law Enforcement (MISLE) but also by posting articles such as those that discuss reoccurring violations or signif- icant findings. The Chief of the Hearing Office also communicates directly with Coast Guard District staff. The feedback has “helped address common errors, omissions, and other significant issues that are encountered in the final adju- dication of violation cases.” All in all, the Coast Guard appar- ently feels it has either closed matters or made significant progress on the Inspector General recommendations. The recommendations from TSAC focused on the expected role of Subchapter M’s option of using safety management systems (SMS) in com- bination with adjustment of reporting levels that provided a two-tier reporting process. Significant casual- ties would be reported to the Coast Guard and less significant captured by the SMS and reported as an aggregate to the Coast Guard periodically for sta- tistical purposes.
