The “damned-if- you-do” side of the frustration arises from a concern that deep inquiries into a mariner’s physical condition will run afoul of theAmericans With Disabilities Act (42 USC §12101)(“ADA”) or with some privacy law. The “damned-if- you-don’t” side of the frustration arises from the concern that if there were ever a marine accident, or if the employee becomes injured, fingers will point at the marine employer as having failed to assure a safe employment context, or as failing in its obligation to protect the public. Let’s first dispel the “damned-if- you-do” concern, as wholly simplistic and inaccurate. Under the ADA, an employer always has a right to inquire and a right to seek a medical examina- tion of any employee if the employer has an objective basis for concern as to an employee’s medical capability on any given day. The employer need not allow the employee to start his or her shift if an objective observation causes concern whether the employee can perform all essential functions safely.
